Most probably fake. If s/he really lost consciousness/drowned, there is not enough depth (buoyancy) to hold up the legs like that. The legs would either have quickly dropped to either side and back, or (more probable) just forward until the arms/handcuffs stopped the legs. That position is very unnatural, and the legs would want to tilt forward to a more natural position. Also note how the kness don't give in and the lower legs fall down.
